Plaintiff's attorney says slip & fall client refuses to cooperate, withdraws as counsel

Beaumont attorney Tom Oxford of Waldman Smallwood has withdrawn from a slip and fall lawsuit on the grounds his client refused to cooperate with him.

As previously reported, Port Arthur resident Tomika Stevenson sued Stop N' Drive No. 7, on May 5, alleging water leaking from the store's cooler caused her to slip.

On Dec. 9 Oxford filed a motion to withdraw "due to plaintiff's failure to cooperate with her attorney," court records show.

That same day, Judge Donald Floyd, 172nd District Court, granted the motion.

According to the lawsuit, on April 27, 2010, Stevenson was shopping at the Port Arthur convenient store "when she slipped and fell in water that was on the floor that was leaking from the cooler."

The suit alleges the defendant should have inspected and maintained its premises and warned patrons of the hazard.

Stevenson is suing for her alleged past and future medical expenses, mental anguish, pain, impairment, disfigurement and lost wages, plus all court costs.
