Subcontractor sues over nonpayment for work on BISD project

A subcontractor is alleging it was not paid for work performed on the French Elementary School building for the Beaumont Independent School District.

Seeking more than $80,000 in actual damages, Avadek filed suit against Allco and Travelers Casualty & Surety Company of America on Feb. 7 in Jefferson County District Court.

A new school, Dr. Mae Jones-Clark Elementary, was built on Cleveland Street to replace French and Field elementary schools.

According to the lawsuit, on May 5 Avadek entered into a subcontract agreement where in it agreed to install aluminum canopies for the new school for $61,103.

A change order increased the amount to $80,406.

"Avadek completely performed its work under the contract and on Aug. 18 ... submitted its application and certificate for payment," the suit states, adding that Allco, however, refuses to pay.

The bond for the work project was posted through Travelers Casualty, which also refused to pay the claim.

Avadek is suing for actual damages and attorney's fees.

Houston attorney Charles Lobb Jr. of Murray Lobb represents the plaintiff.

Judge Gary Sanderson, 6oth District Court, is assigned to the case.
