Social worker sues for 23 years of unpaid overtime

MARSHALL - A social worker has filed a lawsuit in an effort to obtain 23 years of unpaid overtime wages.

Phillip J. Barnhill filed the lawsuit against East Texas Border Health Clinic d/b/a Community Healthcore on Feb. 14 in the Eastern District of Texas, Marshall Division.

Barnhill was employed by the defendant for over twenty-three years as a social worker. He states that the defendant violated the Fair Labor Standards Act by not paying overtime wages at one and one-half times his regular hourly rate for all hours worked in excess of forty hours in a work week.

The plaintiff is asking the Court for an award of damages for unpaid wages, liquidated damages, costs and attorney's fees.

Barnhill is represented by Tyler attorney William S. Hommel Jr. A jury trial is requested.

U.S. District Judge Rodney Gilstrap is assigned to the case.
