Shopper claims falling boxes knocked her down

A Wal-Mart shopper is suing the store, claiming that employees negligently allowed boxes to fall off a shelf, which caused her to be knocked to the ground.

Donna Patterson filed suit against Wal-Mart Stores Texas on Jan. 9 in Jefferson County District Court. Wal-Mart removed the case to the Eastern District of Texas, Beaumont Division on Feb. 20.

The incident occurred on Feb. 15, 2010, as Patterson was shopping at Wal-Mart in Beaumont. She states that while she was shopping, some boxes fell off a shelf and caused her to fall hard to the floor.

Patterson claims that at the time of the accident employees were stocking shelves on the adjacent aisle.

The defendant is accused of negligence for failing to use ordinary care, including the duty to protect and safeguard Patterson from unreasonably dangerous conditions or to warn of their existence.

The plaintiff is asking the Court for an award of damages for medical expenses, loss of earning and earning capacity, physical impairment, physical pain, mental anguish, disfigurement, interest and court costs.

Patterson is represented by Jonathan C. Juhan and J. J. Bragg in Beaumont.

U.S. District Judge Ron Clark is assigned to the case.
