A property owner is taking legal action against a major insurance company, alleging breach of contract and unfair claim settlement practices. On March 7, 2025, Meagan Gauna filed a complaint in the District Court of Harris County, Texas, against Allstate Vehicle and Property Insurance Company. The lawsuit claims that the insurance company improperly denied or underpaid her claim for damages following a significant loss to her property.
According to the court documents, Meagan Gauna holds an insurance policy with Allstate Vehicle and Property Insurance Company for her property located at 4726 Cashel Castle Dr., Houston, Texas. The complaint states that on or about May 28, 2024, Gauna's property suffered serious damage due to a covered loss under the policy. Following this event, she submitted a claim to Allstate for payment of damages as per the terms of the policy. However, Gauna alleges that Allstate failed to properly investigate and evaluate her claim, resulting in an improper denial or underpayment.
The lawsuit further accuses Allstate of engaging in unfair claim settlement practices in violation of Chapter 541 of the Texas Insurance Code. Specifically, it alleges that Allstate misrepresented material facts related to coverage, failed to attempt a prompt and fair settlement once liability was clear, did not provide reasonable explanations for denying claims or offering compromise settlements, and refused to pay without conducting reasonable investigations. These actions are claimed to have caused significant financial harm to Gauna.
Gauna is seeking various forms of relief from the court. She requests monetary compensation for damages including attorney fees and costs associated with prosecuting her case. Additionally, she seeks statutory penalties and interest under Article 542.060 of the Texas Insurance Code for noncompliance with prompt payment statutes. Furthermore, due to what she describes as knowing conduct by Allstate in their handling of her claim, Gauna is also pursuing exemplary and treble damages as permitted by law.
