GALVESTON - Santa Fe resident Floyd Hanson is suing a Chinese restaurant after he fell at its premises, recent court documents say.
A lawsuit filed Feb. 27 in Galveston County District Court claims a dangerous condition at Wong's Express in Santa Fe caused Hanson to injure himself on Sept. 7, 2011.
The plaintiff was in the process of picking up an order from the defendant at the time of the alleged incident.
According to the original petition, Wong's does not provide equal access to individuals with disabilities in the sense it lacked an entrance ramp nor does have handrails.
Hanson adds the parking lot and entrance are full of loose rocks and pebbles which create "an unstable footing or ground."
He faults the eatery for failing to maintain the floor in a reasonably safe condition, failing to give adequate and understandable warnings, failing to remove the pebbles and rocks as well as falling to accommodate to disabled individuals such as himself.
The suit also names Santa Fe local Bernice Vail as a respondent since she presumably owns the property which houses Wong's.
Consequently, the complainant sues for physical pain and suffering, mental anguish, impairment, medical treatment, fear of future disease and losses of earning capacity and consortium.
A jury trial is requested.
Attorney Michael L. Aldous of Santa Fe is representing Hanson, and Galveston County 122nd District Court Judge John Ellisor is presiding over the case.
