A motion to substitute counsel was recently granted in a suit brought by plaintiff Chiquita Armstead, who claims she sustained injuries when her mother's porch partially collapsed.
As previously reported, Armstead filed suit June 23, 2010, in Jefferson County District Court against Arthur Herbert, doing business as Yellow Rose Property Management Co.
Court records show that on Dec. 9 plaintiff's attorney Tom Oxford of Waldman Smallwood in Beaumont filed a motion to substitute counsel, seeking to replace himself with Trent Devenzio of the law firm Branick, Walston & Devenzio.
That same day, Judge Donald Floyd of the 172nd District Court granted the motion.
In her suit, Armstead claims she was visiting a home her mother rented from Herbert at 1380 Pipkin St. in Beaumont when the incident occurred.
"Plaintiff stumbled when the porch partially collapsed causing her to fall backwards resulting in the injuries and damages made the basis of this suit," the complaint says.
Armstead seeks an unspecified judgment, plus pre-judgment interest, costs and other relief the court deems just.
Beaumont attorney Kip Lamb represents the defendants.
