Woman claims elbow, knee injuries from rear-end collision

A Jefferson County woman alleges she sustained elbow and knee injuries after a driver rear-ended her vehicle.

Monica Cardona Diaz filed a lawsuit March 16 in Jefferson County District Court against Elijah Finister.

Diaz claims she stopped in the 1400 block of West State Highway 73 for backed up traffic on Dec. 21, 2011. Suddenly, Finister failed to control his speed and struck the back of Diaz's vehicle, pushing her into the automobile in front of her, according to the complaint.

In addition to her injuries, Diaz incurred medical costs; experienced mental anguish, physical pain, suffering and disability; and lost her enjoyment of life, the suit states. She also lost wages, lost her earning capacity and experienced physical impairment, the complaint says.

Diaz blames Finister for causing the collision, saying she negligently failed to yield the right-of-way, drove inattentively and drove too fast.

Diaz seeks a judgment in excess of the minimum jurisdictional limits of Jefferson County District Court, plus costs, pre- and post-judgment interest and other relief the court deems just.

Clay Dugas and Mike JacobEllis of Beaumont will be representing her.

Judge Donald Floyd, 172nd District Court, has been assigned to the case.
