Tolling agreement reached between injured worker, Newtron

A tolling agreement has been reached between a worker alleging a metal clamp fell on his face and defendant Newtron Inc.

As previously reported, Gerald Greer filed a suit against his employer, Chemtrade Refinery, and contractors Newtron and Betco Scaffold Erection Company, on Sept. 9 in Jefferson County District Court.

Court records show Greer and Newtron reached a tolling agreement on March 30, non-suiting Newtron without prejudice.

The agreement allows Greer to reinstate his claims against Newtron, even if the statute of limitations elapses.

In his suit, Greer claims he was working at defendant Chemtrade Refinery Services's facility on Jan. 26, 2010, when the metal clamp fell on his face.

He alleges the defendants negligently failed to correct the dangerous condition and failed to warn him.

Greer is seeking damages within the jurisdictional limits of Jefferson County District Court, plus pre-judgment interest, costs and other relief the court deems just.

Beaumont attorney Keith Kebodeaux represents Newtron.

Judge Gary Sanderson, 60th District Court, is assigned to the case.
