Hospital accused of intentional infliction of emotional distress after firing pregnant employee

SHERMAN - A hospital employee has filed a lawsuit claiming the hospital intentionally inflicted emotional distress when they fired her during her pregnancy.

Rona Kennedy filed suit against Mayhill Hospital on April 11 in the Eastern District of Texas, Sherman Division.

While employed by the defendant, Kennedy became pregnant in 2011 and had problems with her pregnancy. During this time, she received several write-ups.

According to the suit, she was given doctor's orders not to return to work until Dec. 14, 2011 and she took medical leave under the Family Medical Leave Act.

Kennedy claims she met with the nursing manager and the director of nursing a couple of days later, and was informed that she had already been terminated.

The defendant is accused of unlawful termination of employment, deprivation of equal employment opportunity, creation of a hostile and abusive work environment, and the intentional of emotional distress.

The plaintiff is seeking an award of damages for physical pain, physical impairment, medical bills, mental anguish, emotional distress, extreme embarrassment, humiliation, loss of income, destruction of her professional career, reputation and ability to earn a living, enhanced damages, attorney's fees, court costs and interest.

Kennedy is represented by Dallas attorney Darian Howard.

A jury trial is requested.

U.S. District Judge Richard A. Schell is assigned to the case.
