Car crash defendant seeks to compel plaintiff's evidence of pre-existing injury

GALVESTON - A League City man who is the target of a 2011 lawsuit arising from a two-vehicle accident at a Gulf Freeway intersection has filed a motion to compel against the plaintiff.

Defendant Thomas Garcia asserts that Tacoma, Wash., resident Robin Jordan failed to respond to correspondence dated Feb. 6, 2012, seeking two authorizations, the 11-page motion entered March 21 says.

Jordan filed suit against Garcia before the Galveston County 212th District Court on Oct. 17, 2011, claiming he struck the back of a vehicle in which she was a passenger at the intersection of the Gulf Freeway and W. League City Parkway on Nov. 20, 2009.

Court papers show Garcia "violently struck the plaintiff's vehicle from behind, pushing (it) into the vehicle in front of it."

Police cited the defendant for excessive speeding.

Jordan asserts she did nothing to bring forth the collision.

Garcia submitted an original answer to the allegations on Nov. 23, 2011.

His motion says Jordan turned in medical records that indicate she had pre-existing injuries "relevant to the injuries she claims as a result of this accident" in addition to medical bills from several of her healthcare providers which show reduced charges.

The respondent is represented by David Black & Associates.
