JGALVESTON - Local residents John Sealy and Desiree Sherrick allege their teenage son was hit by a vehicle as he crossed an intersection on Galveston's West End.
According to a lawsuit filed against the city of Galveston on May 18 in Galveston County District Court, Galveston local Sarah Kay Larson struck 14-year-old Trace Sealy with her Toyota Sequoia near Stewart Road and 61st Street the evening of Sept. 29, 2011.
Larson is also a defendant in the case.
Court papers show Trace Sealy was walking in the crosswalk and had almost reached the opposite side of the intersection when the alleged incident occurred.
According to the original petition, the teen "was thrown into the intersection, several feet from impact."
"The impact of defendant Larson's SUV on Trace Sealy was with such force that he was literally knocked out of his shoe," the suit says.
"One shoe and his cap remained in the crosswalk where he was struck, but his body was thrown approximately several feet through the air, almost across Stewart Road, where he landed."
His parents assert "he suffered severe blunt trauma to his head and neck with a straightening of his lordotic curve" as well as "blunt trauma to his right shoulder and arm with closed fracture of the right hand."
The suit adds the teen also dislocated the nerves in his right elbow and continues to suffer from the trauma to his head, elbow, arm and hand.
The city is blamed for failing to properly maintain the intersection while Larson is faulted for violating numerous traffic rules and regulations.
Consequently, the plaintiffs seek unspecified monetary damages and a jury trial.
They are represented by attorney Robert O'Conor Jr. of Houston.
Galveston County 212th District Court Judge Susan Criss is presiding over the case.
