A Spurger man has filed suit against the driver who he claims struck his vehicle.
Jimmy Busby claims he was driving north on U.S. 69 in Beaumont when defendant Ray Harrison Jr., who was traveling in the same direction, failed to control his speed and struck Busby's vehicle.
Because of the collision, Busby experienced cervical neck pain and back pain, incurred medical costs and endured physical pain, suffering and mental anguish, according to the complaint filed May 22 in Jefferson County District Court.
Harrison negligently failed to keep a proper lookout, failed to timely apply his brakes, failed to avoid the accident, failed to control his speed, failed to maintain his vehicle and failed to drive as a reasonable person, the suit states.
In his complaint, Busby is seeking a judgment in excess of the minimum jurisdictional limits of Jefferson County District Court, plus costs, pre- and post-judgment interest at the highest legal interest rate, actual damages and other relief the court deems just.
He will be represented by Ryan Douglas White of Loncar and Associates in Beaumont.
The case has been assigned to Judge Donald Floyd, 172nd District Court.
