Suit filed over wreck on FM 517

GALVESTON - Local residents John and Marion Pandolph blame Dickinson resident Gary Wayne Dean Jr. for a wreck last year in Dickinson.

According to a lawsuit filed May 31 in Galveston County Court at Law No. 3, the plaintiffs were injured while traveling along FM 517 in Dickinson during the early evening of April 5, 2011.

Prior to the collision, the Pandolphs drove eastbound on the roadway while Dean headed westbound.

"Suddenly and without warning, the defendant, while not paying attention, caused his vehicle to turn in front of the plaintiffs' vehicle thereby causing the collision in question and the plaintiffs' resulting injuries/damages," the original petition says.

The suit says the supposed impact resulted in both vehicles to be towed away, adding the complainants sustained "substantial and disabling" injuries which required transport to Clear Lake Regional Hospital.

It blames Dean for failing to keep a proper lookout, failing to timely apply his brakes and failing to take evasive action in order to avoid the subject accident.

Consequently, the plaintiffs sue for physical pain, mental anguish, physical impairment, medical expenses and lost income.

They are represented by attorney Robert D. Clements Jr. with the Law Office of Robert D. Clements Jr. & Assoc. in Alvin.

Galveston County Court at Law No. 3 Judge Christopher Dupuy is presiding over the case.
