Conductor sues Union Pacific after train derailment

TYLER - A Union Pacific train conductor has filed a lawsuit that claims he suffered injuries when the train derailed due Union Pacific's failure to provide a safe place to work.

Marvin Stoxstell filed suit against Union Pacific Railway Co. on June 1 in the Eastern District of Texas, Tyler Division.

The incident occurred on April 20 while Stoxstell was working as a conductor. He states he suffered injuries when the train he was riding on derailed.

The defendant is accused of negligence for failing to provide a reasonably safe place to work. Union Pacific is also accused of violating railroad safety statutes and regulations.

The plaintiff is asking the court for an award of damages for physical pain, suffering, mental anguish, lost wages, loss of earning capacity, medical expenses, physical impairment, interest and court costs.

Stoxstell is represented by Ross Citti and Sara L. Youngdahl of Youngdahl & Citti PC.

A jury trial is requested.
