Man, woman sue driver who caused crash

A Jefferson County woman and man have filed suit against the driver who they claim struck the vehicle in which they were riding.

Ashley J. Molo and Henry Ward claim Molo was driving a vehicle on May 28, 2010, when defendant Robert Samuel Hicks struck it. At the time of the collision, Ward was riding with Molo in the vehicle, according to the complaint filed May 24 in Jefferson County District Court.

Because of the collision, Molo and Ward incurred medical costs; experienced physical pain, suffering, mental anguish and physical impairment; and incurred court costs, the suit states.

Hicks negligently failed to exercise due care, failed to keep a proper lookout, failed to maintain proper control of the vehicle, failed to keep his vehicle in a single lane and failed to swerve to avoid a collision, the complaint says.

In their complaint, Molo and Ward are seeking an unspecified judgment, plus costs, pre- and post-judgment interest and other relief the court deems just.

Jeffrey C. Chilton of Packard Lapray in Beaumont will be representing them.

The case has been assigned to Judge Donald Floyd, 172nd District Court.
