67-year-old man files age discrimination lawsuit after losing job

TYLER - A 67-year-old Tyler resident has filed a discrimination lawsuit against his employer after he was terminated from his job position after 28 years of employment.

James Combest filed suit against Carrier Corp., also known as United Technologies, on June 12 in the Eastern District of Texas, Tyler Division.

Combest began working for the defendant at its facility in Tyler in 1984. He was 67 years old when he was suspended from work on Nov. 29, 2011, pending an investigation of alleged misconduct on his part.

Prior to his suspension, Combest states that he was told that if he took an early retirement, he would be better off. He was terminated on Jan. 12.

Combest believes that he was discriminated against by the defendant based upon his age and based on his heart condition.

The defendant is accused of subjecting Combest to suspension, termination, age-based discrimination, discrimination based on his disability, retaliation based on his age and retaliation based upon Combest using his medical benefits.

The plaintiff is asking for an award of $250,000 in damages for embarrassment, mental anguish, cost of replacement health insurance, pain, undue stress, degradation as a person and humiliation, decrease in wages, plus attorney's fees and court costs.

Combest is represented by Tyler attorney Sten M. Langsjoen. A jury trial is requested.

U.S. District Judge Michael H. Schneider is assigned to the case.
