Fifth Circuit lets ruling stand in asbestos lawsuit fraud case

NEW ORLEANS (Legal Newsline) - The U.S. Court of Appeals for the Fifth Circuit has chosen not to revisit its recent decision that affirmed a fraud verdict against two Mississippi asbestos attorneys.

William Guy and Thomas Brock had asked for the full roster of Fifth Circuit judges to hear their appeal, but no judges requested a poll and their motion was denied Monday.

A three-judge panel ruled on May 29 that the two unfairly hid two of their clients' previous involvement in an asbestos mass action, inducing Illinois Central Railroad to pay $210,000 in settlements.
