Plant worker sues after filter basket falls on him

Area resident Terry Daigle is suing The Shaw Group for injuries he received when a filter basket fell on him.

The suit was filed July 17 in Jefferson County District Court.

According to the lawsuit, on Sept. 13, 2011, Daigle, a Goodyear employee in the course of his employment, was lifting a wheatly (filter) basket with a hoist when the trolley hanging the hoist fell off a monorail, causing the equipment to fall on him.

Allegedly, Shaw had removed part of the monorail without notifying Goodyear and its employees.

The suit alleges the defendant negligently failed to tag out an inoperable piece of equipment.

The plaintiff is suing for his alleged past and future medical expenses, mental anguish, pain, impairment, disfigurement and lost wages, plus all court costs.

Provost Umphrey attorney Jane Leger represents him.

Judge Donald Floyd, 172nd District Court, is assigned to the case.

Case No. E192-683
