Suit says driver left scene of crash

A Port Arthur woman has filed suit against the driver who she claims struck her vehicle.

Debbie Simmons claims she was involved in a collision with defendant Jacquelyn Channel on Aug. 17, 2010.

Because of the collision, Simmons incurred medical costs and suffered physical pain, mental anguish, physical impairment and disability, according to the complaint filed July 12 in Jefferson County District Court.

Channel negligently failed to yield the right-of-way, failed to control her speed, failed to maintain proper control of her vehicle, failed to timely apply her brakes, failed to stop at a stop sign, left the scene of an accident and failed to take evasive action to avoid the collision, among other negligent acts, the suit states.

In addition to Jacquelyn Channel, Simmons names the vehicle's owner, Evan Channel, as a defendant, saying he negligently entrusted his vehicle to Jacquelyn Channel.

In her complaint, Simmons is seeking an unspecified judgment, plus interest at the legal rate, costs and other relief the court deems just.

The case has been assigned to Judge Donald Floyd, 172nd District Court.
