An older Wal-Mart employee has filed a lawsuit against the store for age discrimination after she was terminated from her position within the Claims Department.
Lois Harris filed suit against Wal-Mart Stores Inc. and Leah C. Loerwald on Sept. 2, 2011 in Orange County District Court. The defendants removed the case to the Eastern District of Texas, Beaumont Division.
Harris is over 65 years of age and was employed by Wal-Mart in the claims department. She allegedly was terminated on Oct. 19, 2010, for shipping a pallet of chemicals to a warehouse five months earlier. Harris states that this is a pretext as she was following directions of management.
The defendants are accused of age discrimination in violation of the Texas Labor Code
The plaintiff is asking the court for an award of damages for back pay, front-pay, actual damages for mental anguish and depression, exemplary damages, interest, and court costs.
Harris is represented by Clay Dugas and Mike Jacobellis of Clay Dugas & Associates in Beaumont. A jury trial is requested.
U.S. District Judge Ron Clark is assigned to the case.
