A Colorado company has filed suit against the woman that it claims owes it more than $1,000 in medical bills she incurred following a collision.
Medical Lien Management doing business as Bridgewell claims it treated defendant Danielle St. Romain after she was injured in an accident on Dec. 19, 2008. St. Romain incurred $1,819 worth of costs at Medical Lien Management, according to the complaint filed July 30 in Jefferson County District Court.
Medical Lien Management agreed to wait until after St. Romain secured money from a lawsuit she planned to file against the driver before it pursued her for payment, the suit states. However, St. Romain never filed a complaint and instead settled with the driver's insurance company on March 29, 2010, for $25,000, the complaint says.
Following the settlement, St. Romain, upon the advice of her lawyer, defendant Clay Dugas, offered to pay Medical Lien Management $253.39 instead of the nearly $2,000 owed, the company claims. Medical Lien Management opted to reject the St. Romain's offer, according to the complaint.
On Dec. 22, 2011, St. Romain again offered to settle -- this time for $634.21, the suit states. Again, Medical Lien Management rejected the offer, the complaint says.
Medical Lien Management alleges breach of contract against Dugas and unjust enrichment against Dugas and Crosson.
In its complaint, Medical Lien Management is seeking compensatory damages, plus attorneys' fees, costs, pre- and post-judgment interest, foreclosure on Crosson's lien and other relief the court deems just.
It will be represented by Robert Miklos, Ryan A. Starnes and Mitchell S. Milby of Dallas.
The case has been assigned to Judge Donald Floyd, 172nd District Court.
