SHERMAN - A Wylie woman has filed a lawsuit against a Houston law firm that claims the firm violated Texas and federal debt collection law by threatening to file a lawsuit against her.
Cristy Galan filed suit against ANH Regent, doing business as Law Offices of Regent & Associates, and Regent & Associates PC, doing business as Law Offices of Regent & Associates, on Aug. 16 in the Eastern District of Texas, Sherman Division.
The defendant allegedly made collection attempts by sending letters and placing telephone calls to Galan's cellular telephone.
According to the lawsuit, in July 2012, the defendant left a voicemail message that implied a lawsuit would be filed unless Galan contacted their law office voluntarily.
The defendant is accused of violating the Fair Debt Collection Practices Act by threatening to take action that it does not intend to take, for using false representations or deceptive means to collect a debt, and for failing to disclose that it was a debt collector.
The defendant is also accused of violating the Texas Finance Code.
The plaintiff is asking for an award of statutory damages, court costs, and attorney's fees.
Galan is represented by Douglas Baek of Krohn & Moss Ltd. in Los Angeles, Calif.
U.S. District Judge Ron Clark is assigned to the case.
