The superintendent of a roofing project claims he was not fully paid for work he performed.
Ward Gregory Woodworth filed a lawsuit Aug. 10 in Jefferson County District Court against Monument Constructors, doing business as Monument Roofing Systems, and the Texas Workforce Commission.
In his complaint, Woodworth alleges he was working for Monument as a superintendent on large commercial roofing projects throughout Texas. For his work, Woodworth was supposed to receive a $1 per square foot bonus for each 100 square feet of roofing. He was also supposed to be compensated for any unused vacation time, according to the complaint.
However, Woodworth alleges he was not paid the money he was owed, the suit states.
In turn, Woodworth filed a claim with the Texas Workforce Commission, asking for the compensation he deems just, the complaint says. However, the Texas Workforce Commission denied the claim.
"Defendant Texas Workforce Commission's final determination that Mr. Woodworth was not eligible to recover unpaid wages due to not timely filing his claim is legally erroneous and not reasonably supported by substantial evidence," the suit states.
In his complaint, Woodworth wants the court to find that he is entitled to receive unpaid wages, plus other relief the court deems just.
Eric Wayne Newell of Brent Coon and Associates in Beaumont will be representing him.
Judge Bob Wortham, 58th District Court, has been assigned to the case.
