Harris County man claims other driver was intoxicated



A Harris County man has filed suit against the allegedly intoxicated driver who he claims rear-ended his vehicle.

Horace N. Green claims he was driving south on Spur 215 near 19th Street in Port Arthur on Aug. 3 when defendant Tara L. Prevost suddenly rear-ended his vehicle.

Because of the collision, Green sustained physical pain, mental anguish, physical impairment and physical disfigurement; lost earnings and his earning capacity; and incurred medical costs, according to the complaint filed Aug. 15 in Jefferson County District Court.

Prevost negligently failed to keep a proper lookout, failed to keep a safe speed, drove too closely to Green's vehicle, drove inattentively and drove while intoxicated, the suit states.

In his complaint, Green seeks a judgment within the jurisdictional limits of Jefferson County District Court, plus pre-judgment interest at the maximum rate, post-judgment interest at the legal rate, costs and other relief the court deems just.

Mehran "Mike" Talabi, Husein Hadi and Sean Palavan of Talabi and Associates in Houston will be representing him.

The case has been assigned to Judge Bob Wortham, 58th District Court.
