Slip and fall dismissed two months after filing

Two months after filing a slip and fall lawsuit, Orange resident Kay Wysong had the case dismissed.

Seeking damages for her alleged injuries, Wysong filed suit against Trisun Healthcare (the Meadows of Orange Nursing and Rehab) and Harden Health Care in Orange County District Court.

According to the lawsuit, on April 30, 2011, Wysong was working for the defendants when she slipped on condensation from the freezer that accumulated on the kitchen floor.

Court records show that on July 31, Wysong filed an agreed motion to dismiss, stating that the matter has been disposed of without the need of further litigation.

Judge Courtney Arkeen of the 128th District Court dismissed the defendants with prejudice on Aug. 2, court records show.

In her suit, Wysong had accused the defendants of negligently failing to provide a safe place to work and failing to warn her of the dangerous condition.

She was seeking a judgment in an amount in excess of the minimum jurisdictional limits of the court.
