AAA Truck Agency sued for trucker’s collision

AAA Truck Agency has been sued for an automobile collision allegedly caused by one of its truck drivers.

Martha Nieto and Jose Vera filed the suit against AAA Truck Agency and John Bailey on Aug. 22 in Jefferson County District Court.

According to the lawsuit, on March 30, 2011, the plaintiffs were driving eastbound on Interstate 10 and had slowed for traffic in front of them when they were struck from behind by a truck owned by AAA Truck Agency and driven by Bailey, who was acting in the course and scope of his employment.

The plaintiffs were both allegedly injured in the collision.

The suit faults AAA Truck Agency with negligent entrustment and further accuses Bailey of excessive speed, following too close and negligently failing to keep a proper lookout.

The plaintiffs are suing for their alleged past and future medical expenses, mental anguish, pain, impairment, disfigurement and lost wages, plus all court costs.

Beaumont attorney Clay Dugas represents them.

Judge Donald Floyd, 172nd District Court, is assigned to the case.
