Beaumont attorney Adam Terrell has withdrawn from an automobile collision lawsuit he filed on behalf of plaintiff Thomas Davis.
Davis filed suit against Nederland resident Alan Kelley on Jan. 3 in Jefferson County District Court, seeking to recover monetary damages for injuries he suffered in a motor vehicle collision.
Court records show that on Aug. 10 Terrell, attorney for the Beaumont law firm Weller, Green, Toups & Terrell, filed a motion to withdraw.
The motion states that he can no longer effectively communicate with Christopher Cappel, another plaintiff in the case.
Judge Bob Wortham, 58th District Court, granted the motion on Aug. 27, court papers say.
According to the petition, on Jan. 6, 2009, Davis and two passengers were traveling somewhere in Jefferson County when Kelley negligently collided with his vehicle.
The suit alleges Kelley negligently failed to keep a proper lookout, maintain a safe distance between vehicles, control his rate of speed, and apply his brakes in a timely manner.
The plaintiff is suing for his alleged past and future mental anguish, pain, lost wages, impairment and medical expenses.
