Man struck by vehicle in construction zone, sues Valero

While walking in a construction zone, area resident Mark Sherette was struck by a vehicle being driven by a Valero employee.

On Sept. 5 Sherette filed suit against Valero Energy and the employee, John Doe Gauthier, in Jefferson County District Court, seeking monetary compensation for his injuries.

According to the lawsuit, on Dec. 3, 2010, Sherette was walking in a construction zone when he was struck by a vehicle being driven by Gauthier, who was in the course and scope of his employment with Valero.

Although the suit does not state why Sherette was at the site, the suit does say that nothing he did contributed to his injuries.

The suit accuses Gauthier of negligently failing to keep a proper lookout and maintain a proper speed.

Valero is accused of failing to supervise its employees and maintain a safe workplace.

The plaintiff is suing for his alleged past and future medical expenses, mental anguish, pain, impairment, disfigurement and lost wages, plus all court costs.

Beaumont attorney Clint Basher represents him.

Judge Milton Shuffield, 136th District Court, is assigned to the case.
