A Kansas City Southern Railway employee is suing the company for injuries he allegedly received when a train stuck a tree on the track.
Under the Federal Employer’s Liability Act, area resident Bryan Coles filed suit against KCS on Sept. 11 in Jefferson County District Court.
According to the lawsuit, on Feb. 16 Coles was working as an engineer for KCS when his train struck a tree on the track, causing unspecified injuries.
In his suit, Coles alleges his injuries were caused by the negligence of KCS and its employees. However, the suit fails to list any specific act of negligence committed by KCS.
The plaintiff is suing for his alleged past and future medical expenses, mental anguish, pain, impairment and lost wages.
