Suit alleging banks set couple up for foreclosure transferred to federal court

A suit filed in Jefferson County alleging defendant banks set a Beaumont couple up for foreclosure has been transferred to federal court. 

As previously reported, Vertress and Melonie Slack filed suit against Ocwen Loan Servicing and Deutsche Bank National Trust Co. on July 20 in Jefferson County District Court.

Court records show that on Aug. 16 a notice of removal was filed notifying the court that the case had been removed to the U.S. District Court for the Eastern District of Texas, Beaumont Division.

The suit states that from 2010 to 2012 the defendants refused to accept payments from the Slacks in order to “set plaintiffs up for foreclosure.”

The defendants also allegedly had collection agents harass the couple.

The suit further alleges the defendants have taken the Slacks’ monies and refused to apply it to the principal and interest of the mortgage, “setting the stage for foreclosure of (their) home.”

The defendants are accused of breaching their contracts and breach of fiduciary duty.

The plaintiffs are seeking exemplary and actual damages.

Beaumont attorney Daniel Clayton represents them.

Judge Bob Wortham, 58th District Court, was originally assigned to the case.
