Bounced check results in suit

Dollar & More has filed suit against Ursula Keller, alleging a check she cashed with the company bounced.

The suit was filed Sept. 19 in Jefferson County District Court.

According to the lawsuit, on April 20, 2011, Dollar & More cashed a check made payable to Keller and Kinsel Ford in the amount of $4,739 with the assurance of Keller that her and Kinsel Ford’s endorsements were valid.

Two days later, Dollar & More deposited the check. Later the funds were withdrawn from the account with the explanation that Kinsel Ford’s endorsement was not valid.

“Plaintiff provided defendant with the facts … and gave defendant the opportunity to correct the error,” the suit states. “Defendant has not done so.”

The suit accuses Keller of committing fraud.

Dollar & More is suing for actual and exemplary damages.

Beaumont attorney Chris Portner of Portner Bond represents the plaintiff.

Judge Gary Sanderson, 6oth District Court, is assigned to the case.
