As an authorized servicing agent for Bombardier Capital, Green Tree Servicing has filed suit against Melinda and David Greer, seeking possession of a manufactured home.
The suit was filed Oct. 1 in Jefferson County District Court.
According to the lawsuit, Green Tree Servicing is the holder of retail installment contract and security agreement executed by the Greers on July 24, 1999, and holds a perfected security interest in a manufactured home.
The couple defaulted on the contract and was given notice of default but failed to cure, the suit states.
“Accordingly, Green Tree requests that this court enter judgment requiring the sheriff or constable of the county where the collateral is located to seize the collateral and deliver possession … to Green Tree,” the suit states.
“In the alternative and without waiving the forgoing, Green Tree seeks payment in the amount of $54,234.94.”
Green Tree Servicing is also seeking to recover court costs and attorney’s fees.
Dallas attorney Natalie Paul of Johnson & Silver represents the company.
Judge Bob Wortham, 58th District Court, is assigned to the case.
