Discovery now underway in slip-and-fall against CVS

Discovery has started in a slip-and-fall lawsuit against Caremark, doing business as CVS Pharmacy.

Lumberton residents Lisa and Ray Tidwell have filed the suit June 27 in Jefferson County District Court.

Court records show that a certificate of discovery was filed on Oct.1, stating that the defendant has been served with the plaintiff’s interrogatories and requests for production and disclosure.

According to the lawsuit, on June 25, 2011, Lisa Tidwell was shopping at CVS when she slipped and fell, resulting in permanent and disabling injuries.

The suit does not state how the incident occurred.

Lisa Tidwell is suing for her alleged past and future medical expenses, mental anguish, pain, impairment and lost wages, plus all court costs.

Ray Tidwell is seeking loss of consortium damages.

Provost Umphrey attorney Paul Ferguson Jr. of Beaumont represents them.

Judge Milton Shuffield, 136th District Court, is assigned to the case.
