Angleton auto dealership files suit over two-vehicle accident

GALVESTON - A Brazoria County auto dealership has filed suit over a two-vehicle accident in Friendswood in late 2010, recent court documents say.

A lawsuit filed Oct. 9 in Galveston County District Court claims a vehicle belonging Gulf Coast Chevrolet in Angleton was struck by that driven by Houston resident Mercy M. Guy along W. Parkwood Avenue on Oct. 26, 2010.

The suit explains that motorist Richard Earl Armstrong was traveling eastbound in the middle lane of the 700 block of West Parkwood just as the defendant, who was going westbound and making a left hand turn from the left turn lane in the 600 block of the same street, collided with him.

The suit, which does not identify Armstrong as either an employee or a customer, states he was hit "suddenly and without warning," claiming the other driver failed to yield the right of way.

It blames the respondent for:


  • Failing to keep a proper lookout;

  • Failing to make a proper and timely application of brakes;

  • Failing to maintain control of the vehicle;

  • Failing to turn said vehicle either left or right;

  • Failing to obey a traffic control device; and

  • Failing to maintain a safe, assured distance.


The dealership says Armstrong sustained "serious and permanent" injuries as a result of the subject event.

It is also suing Edmond Guy, another Houston resident, since it was his vehicle which supposedly caused the wreck.

Consequently, the plaintiff seeks unspecified monetary damages.

Attorney Kyle R. Hejl with Walters Balido & Crain L.L.P. is representing Gulf Coast Chevrolet, and Galveston County 10th District Court Judge David Garner is presiding over the case.
