Vaginal mesh makers sued over numerous defects

A Jasper County woman has filed a lawsuit against two manufacturers of surgical vaginal mesh claiming that the devices have numerous defects which creates high risks of injuries. 

Wilma Darlene England and R. P. England filed suit against American Medical Systems Inc. and AMS Research Corp. on Aug. 23 in Jasper County District Court. The case was removed to the Eastern District of Texas, Beaumont Division on Oct. 15.

England was implanted with a surgical mesh device, known as the Elevate and IntePro Lite, on Aug. 24, 2010. The medical devices or systems are implanted to treat certain women with gynecological/urological medical issues. She states that since that surgery and implantation, she has experienced significant injury and has undergone corrective surgery.

According to the lawsuit, the surgical mesh has numerous defects that create a high risk of unreasonable risk of injuries and side effects with severe permanent adverse health consequences, including vaginal erosion, infection, extrusion, perforation, chronic pain, and abscess.

The defendants are accused of strict liability defective manufacture, defective design, marketing defect, negligence, and breach of warranty.

The plaintiff is asking for an award of damages for mental and physical pain and suffering, economic loss, loss of consortium, punitive damages, attorney’s fees, medical expenses, court costs, and interest.

England is represented by B. Adam Terrell of Weller, Green, Toups & Terrell in Beaumont. A jury trial is requested.
