A Harris County man has filed suit against the truck driver who he claims suddenly switched lanes and struck his vehicle.
Kevin Dorsey claims he was driving on a narrow stretch of Interstate 10 on May 15, 2011, when defendant Nathan Allen Murray, who was driving an 18-wheeler at 65 miles per hour, “abruptly changed lanes without engaging his turn signal, and without looking in his mirror.”
The truck collided with Dorsey’s vehicle, causing him to incur medical costs; to experience physical pain, mental anguish and physical impairment; and lost wages and his earning capacity, according to the complaint filed Oct. 10 in Jefferson County District Court. He also suffered numerous injuries, including acute myofascitis, acute post traumatic headaches, cervical neuritis and cervical sprain, the suit states.
Murray negligently failed to drive in an attentive manner, failed to control the speed of his vehicle, failed to maintain a proper lookout, failed to keep proper control of his vehicle, failed to timely apply the brakes of his vehicle, failed to warn of an impending collision, failed to take proper evasive action and failed to avoid the collision, the complaint says.
Dorsey is seeking actual and exemplary damages, plus pre- and post-judgment interest, costs and other relief the court deems just.
