A Jefferson County woman seeks money from her insurance company after she claims she got into a collision with an under-insured driver.
Sandra Ferguson filed a lawsuit Oct. 22 in Jefferson County District Court against Progressive County Mutual Insurance Co.
In her complaint, Ferguson alleges she drove through the parking lot of Tinseltown Movie Theaters in Beaumont on May 13, 2011, when Derek David struck the front passenger’s side of her vehicle, causing her to sustain substantial neck injuries.
Because of the collision, in addition to her injuries, Ferguson incurred medical costs; experienced mental anguish, physical pain, suffering and disability; and lost her enjoyment of life, according to the complaint. She also endured physical impairment, lost wages and lost her earning capacity, the suit states.
Ferguson blames David for causing the collision, saying he negligently sped, failed to keep a proper lookout, failed to timely apply his brakes and failed to yield the right-of-way.
At the time of the collision, David had an insurance policy that paid Ferguson $50,000. However, Ferguson’s damages were more than that, according to the complaint. Now, she seeks money from her insurance company, Progressive, the suit states.
In her complaint, Ferguson is seeking unspecified damages, plus costs, pre- and post-judgment interest and other relief the court deems just.
