Man blames deceased driver for injuries in collision

A Jefferson County man claims he sustained injuries in a collision with a deceased driver. 

Michael Wayne Guillory filed a lawsuit Oct. 25 in Jefferson County District Court against David Bartsch Jr. as independent administrator of the estate of David Bartsch Sr. and Anahuac Transport, Inc.

Guillory claims he sustained personal injuries in an automobile accident with the recently deceased David Bartsch Sr. on July 24, 2012. At the time of the collision, David Bartsch Sr. was driving a vehicle for Anahuac Transport, which failed to provide proper insurance coverage for the vehicle Bartsch was driving, according to the complaint.

Because of the collision, Guillory incurred medical costs, experienced physical pain and suffering and endured physical impairment, the suit states. He also incurred property damages, lost earnings and suffered mental anguish, the complaint says.

Guillory blames David Bartsch Sr. for causing the collision, saying he negligently failed to keep a proper lookout, failed to yield the right-of-way, drove too fast and failed to apply his brakes in a timely manner.

In his complaint, Guillory seeks a judgment in excess of the minimum jurisdictional limits of Jefferson County District Court, plus pre- and post-judgment interest, costs and other relief the court deems just.

The case has been assigned to Judge Milton Shuffield, 136th District Court.
