Farmers sued for not paying underinsured motorist benefits

Earlier this year, Port Arthur resident Leon DeLeon was in a collision with a man traveling the wrong way on a highway.

On Oct. 30 DeLeon filed suit against his insurance provider, Farmers Texas County Mutual Insurance, in Jefferson County District Court, alleging the company refused to pay underinsured motorist benefits following the collision.

According to the lawsuit, on Feb. 8 DeLeon was in a collision with a motorist traveling the wrong way on a one-way highway.

At the time of the incident, DeLeon was covered by a Famers automobile policy, which included underinsured motorist benefits.

“Plaintiff would further show that he has complied with all terms and conditions required to recover benefits under the policy,” the suit states. “Defendant has refused … to pay plaintiff the requisite benefits under this policy.”

DeLeon is suing for actual damages and court costs.

He is represented by Beaumont attorney David Wilson of the Provost Umphrey law firm.

Judge Bob Wortham, 58th District Court, is assigned to the case.
