Alleging she tripped over a loose board on a bridge while walking her dog two years ago, Port Arthur resident Pati Paulino has filed suit seeking exemplary damages against the city.
The suit was filed Nov. 6 in Jefferson County District Court.
According to the lawsuit, on Nov. 8, 2010, Paulino was walking her dog in Herman Park in Port Arthur.
“She proceed (sic) to walk across a suspended bridge when one of the floor boards came lose (sic), causing her to fall,” the suit states. “Due to the defendant’s negligence serious injury resulted.”
The suit does not state the nature of Paulino’s alleged injury but does allege the city acted with malice, entitling her to exemplary damages.
The suit further accuses the city of negligently failing to inspect and maintain its premises, and warn walkers of the hazardous condition.
The plaintiff is suing for her alleged past and future medical expenses, mental anguish, pain, impairment, disfigurement and lost wages.
