Lawsuit filed over alleged failure to pay for supplies

A supply company has filed suit against a roofing business, claiming the roofers failed to pay it more than $20,000 for materials it delivered.

American Builders and Contractors Supply doing business as ABC Supply Co. claims it sold and delivered certain materials to defendant Integris Roofing Services. In turn, Integris promised to repay ABC Supply, according to the complaint filed Nov. 5 in Jefferson County District Court.

However, Integris has refused to repay ABC Supply $24,939.10 despite ABC Supply’s repeated requests that the roofing company do so, the suit states.

If Integris failed to pay for the materials, defendants The Insurance Company of the State of Pennsylvania and Kent Reese agreed to do so under the terms of a bond they issued. However, they also failed to make the required payments, the complaint says.

In its complaint, ABC Supply is seeking an order mandating the payment of the $24,939.10 under the bond, a judgment against the defendants for the money allegedly owed, pre- and post-judgment interest, costs and other relief the court deems just.

Randall F. Adair and Daniel S. Bowns of Adair, Morris and Osborn will be representing it.

The case has been assigned to Judge Gary Sanderson, 60th District Court.
