Suit brought over fatal shooting

Andy Marshall, the surviving child of Linda Gilbert, has brought a wrongful death suit against Felix Gilbert, alleging he shot and killed his mother. 

The suit was filed Nov. 16 in Jefferson County District Court.

According to the lawsuit, on June 29, 2011, Linda Gilbert, 65, was shot and killed when Felix Gilbert negligently discharged his firearm.

The suit does not give any further details about the incident, nor does the suit state where the incident occurred.

“Defendant breached his duty to Linda … by discharging his firearm in a reckless and negligent manner,” the suit states, adding that Felix had a duty to handle his gun with reasonable care.

The plaintiff is suing for his loss of companionship, mental anguish and loss of inheritance.

B. Adam Terrell of Weller, Green, Toups and Terrell in Beaumont will be representing him.

Judge Gary Sanderson, 6oth District Court, is assigned to the case.
