Motion for default judgment entered into lawsuit against Texas City mechanic

GALVESTON - A motion for default judgment was recently submitted into a Pasadena man's $26,000 lawsuit against a Texas City mechanic, recent court records show.

David Michael Adams is suing Johnny Washington, doing business as J&C Auto Body Repair Paint, alleging his 2007 Lexus IS350 was not properly repaired.

Court papers filed back in August state that Adams brought the vehicle to Washington on Jan. 14, 2010, who allegedly stated “that he was qualified to perform the necessary repairs, including repairs to the electrical system and body work on the car."

The plaintiff paid a total of $13,000, but claims he eventually discovered that “only minimal repairs, if any at all, were made to the car.” He then demanded its release and a refund, the suit says.

Both parties then entered into a payment agreement calling for the defendant to reimburse Adams the $13,000 in dispute.

Meanwhile, the suit states that the car was then sold to a salvage company for “below what would have been the market value of the vehicle had it been properly repaired.”

Adams entered the motion because Washington failed to provide an original answer by the Sept. 24 deadline.

He also "had not entered an appearance in this matter," according to the two-page document.
