Houston man sues Hitchcock ISD over collision with bus

Patterson gary

GALVESTON - After he reportedly collided with a vehicle belonging to the Hitchcock Independent School District, Houston resident Sadiq Ali Lakhani has filed a lawsuit.

Recent court documents filed Nov. 27 in Galveston County District Court allege HISD bus driver Jason Noyola rear-ended Lakhani along a stretch of Highway 6 on the morning of Jan. 23.

According to the original petition, Noyola, who is not a defendant in the case, "failed to control his speed and violently slammed into the rear end of Lakhani's vehicle."

The suit further asserts the collision in question caused the plaintiff's vehicle to violently spin clockwise and strike a vacuum station located on the nearby Stop and Drive premises.

King Lakhani Enterprises Inc., the property owner, is also a plaintiff.

Lakhani invokes the writ of respondeat superior against the school district since Noyola was on its time at the time of the alleged events.

HISD is additionally faulted for:

  • Failing to keep a proper lookout;

  • Failing to timely apply the brakes;

  • Failing to maintain the vehicle under control; and

  • Failing to operate said vehicle in a safe and prudent manner.

Consequently, Lakhani sues for physical pain and suffering, loss of earnings and medical expenses while King Lakhani seeks damages for repairs and losses of profits and property use.

Attorney Gary E. Patterson with Gary E. Patterson P.C. in Houston is representing the complainants.

Galveston County 212th District Court Judge Susan Criss is presiding over the case.
