MARSHALL - Claiming his implanted abdominal mesh has eroded, Gregg County resident Charles B. Green has filed a lawsuit against the manufacturer C.R. Bard Inc. on Nov. 29 in the Eastern District of Texas, Marshall Division.
According to the suit, Green was treated at the Veteran’s Administration Medical Center in Shreveport on July 26, 2011, for a diagnosis of bilateral femoral hernias and Bard mesh plugs implanted. Green alleges his condition was not remedied by this procedure and he subsequently became physically worse.
“Green continues to suffer from unbearable pain and believes that the mesh has become infected, dislodged, and possibly eroding into Mr. Green’s intestines,” the lawsuit states.
The defendant is accused of strict liability, negligence and breach of warranty.
Green argues that the defendant did not reasonably test to determine if the mesh was fit for its intended purpose of implantation in the human body.
The plaintiff is seeking an award of damages for physical pain and suffering, mental anguish, emotional distress, disability, physical impairment, loss of enjoyment of life, loss of earning capacity, medical expenses, attorney’s fees, interest and court costs.
Green is represented by Longview attorneys Dan Stroup of Dan Stroup PC and Blake C. Erskine of Erskine & McMahon. A jury trial is requested.
U.S. District Judge Rodney Gilstrap is assigned to the case.
