If she does not mediate her personal injury claim before June 14, Kristen Peterson will face a July trial.
Peterson, while playing in an inflatable moonwalk, fractured her vertebrae when the children’s attraction collapsed.
As previously reported, on May 9 Peterson filed suit against Bieber Enterprises, doing business as Jumping Jack Moonwalks, in Jefferson County District Court, alleging the company failed to properly set up the moonwalk.
A discovery control plan order was entered in the case on Oct. 24, calling for the case to be mediated before or on June 14 or face a trial sometime in July, court papers say.
The lawsuit alleges that on Sept. 4, 2011, Peterson was a guest at a party, of which activities included inflatable playground equipment rented from Jumping Jack Moonwalks.
“While utilizing the inflatable equipment, the equipment collapsed, causing plaintiff to fall and suffer serious and permanent bodily injuries, including fractured vertebrae,” the suit alleges.
It also alleges the defendant negligently failed to properly set up the equipment and inspect it for dangerous conditions.
The suit does not state how old Peterson was at the time of the incident.
She is suing for her alleged past and future medical expenses, mental anguish, pain, impairment, disfigurement and lost wages, plus all court costs.
Attorney Hart Green of the Beaumont law firm Weller, Green, Toups & Terrell represents her.
Judge Bob Wortham, 58th District Court, is assigned to the case.
