Two years ago, Dale Jacobs slipped on some fuel as she stepped out of her vehicle at a gas station.
On Nov. 29 Jacobs filed suit against Speedy Stop Food Stores in Jefferson County District Court, seeking damages in an amount not to exceed $1 million.
According to the lawsuit, on Dec. 6, 2010, Jacobs made a stop at a Speedy Stop in Beaumont. As she stepped out of her vehicle, she slipped and fell on fuel that was on the slick pavement.
“No warning signs were placed to warn of the dangerous slippery surface, no mats were placed over the dangerous slippery surface, there was no sawdust or other agent to soak up the fuel and plaintiff was given no other verbal or visual warning,” the suit states.
“Plaintiff was injured … and required medical attention.”
The suit further alleges the defendant owed Jacobs a duty to cure the premises of the dangerous condition.
In amount not to exceed $1 million, the plaintiff is suing for her alleged past and future medical expenses, mental anguish, pain, disfigurement and lost wages, plus all court costs.
San Antonio attorney Scott Tschirhart represents her.
Judge Gary Sanderson, 6oth District Court, is assigned to the case.
