Suit claims insurer failed to cover policyholder in 2009 auto accident

GALVESTON - Galveston local Laura Jiminez alleges her insurance company has failed and refused to properly cover for an auto accident she was in three years ago and has filed suit. 

Jiminez's lawsuit, filed Dec. 6 in Galveston County District Court, accuses IDS Property Casualty Insurance Co. of committing breach of contract and bad faith insurance practices.

The suit shows Jiminez first got into a wreck in Galveston on Dec. 9, 2009, in which her 2000 Honda Accord was affected.

At the time of the event in question, she was a policyholder with the defendant and demand for payment of proceeds available pursuant to the personal injury protection benefits uninsured was presented last month.

Copies of medical records, patient account charges and evidence of medical charges were submitted as the insurer requested, but the defendant "has failed to heed the demand and requests and has opted to disregard and/or offer less, and/or evaluate these claims in a manner that is reasonable and fair and/or provide an evaluation and compensation as is required pursuant to the policy of coverage," the suit says.

Attorney Douglas T. Godinich with The Law Office of Douglas T. Godinich in Galveston is representing the plaintiff, and Galveston County 405th District Court Judge Wayne Mallia is presiding over the case.
