Alleging her Camry was not sufficiently crashworthy, Brandi Scharber has filed suit against Toyota Motor Corp. and the woman who struck her head-on, Gayle-Marie Purcell.
The suit was filed Dec. 3 in Jefferson County District Court.
According to the lawsuit, on June 8 Scharber was driving a 2000 Toyota Camry and traveling on Major Drive in Beaumont when Purcell struck her head-on.
At the time of the incident, Scharber was wearing her seat belt; however, the vehicle still failed to protect her, the suit claims.
The suit accuses Toyota for negligently building and selling a vehicle that was not reasonably crashworthy. Purcell is accused of negligently failing to obey traffic laws and keep a proper lookout.
On top of actual damages, the plaintiff is suing for her alleged past and future medical expenses, mental anguish, pain, impairment, disfigurement and lost wages, plus all court costs.
